A National Day of Mourning will be observed in New South Wales and Victoria on Thursday, 22 September 2022, following Prime Minister Anthony Albanese’s announcement after the death of Her Majesty the Queen.
The day will be a normal trading day, consistent with Grand Final Friday and Boxing Day. It will mean that Public Holiday rules and entitlements will apply. Employees have a right to be away from work on a public holiday. However, an employer can ask an employee to work on a public holiday if the request is reasonable. An employee may refuse a request to work if they have reasonable grounds. (Fair Work Ombudsman).
If you are covered by an award, enterprise agreement, or other registered agreement. You may be entitled to a higher pay rate for working on a public holiday or gain an extra day off or additional annual leave.
The Queen’s Birthday public holiday will remain on 12 June and be renamed the King’s Birthday.
